Terms and Conditions

You agree to the terms and conditions outlined in this Terms and Conditions of use Agreement (Agreement). This Agreement constitutes the entire and only agreement between BNR Supercars, LLC doing business as BNRturbos.com and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the product and services listed on the website, and the subject matter of this Agreement. This Agreement may be amended by us at any time and at any frequency without specific notice to you. The latest Agreement will be posted on this web page, and you should review this Agreement prior to purchasing the product.

1. INDEMNIFICATION: You agree to indemnify, defend and hold us, our officers, our shareholders, our partners, attorneys and employees harmless from any and all liability, loss, damages, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the product and services listed.

2. Limited License: Subject to the terms and conditions set forth in this Agreement, BNR Supercars, LLC grants you a non-exclusive, non-transferable, limited right to access, use and display this site and the materials thereon. You agree not to interrupt or attempt to interrupt the operation of the site in any way and agree to indemnify BNR Supercars, LLC for all costs and damages associated with any interruption or attempted interruption. BNR Supercars, authorizes you to view and download the information ("Materials") at this Web site ("Site") only for your personal, non-commercial use. This authorization is not a transfer of title in the Materials or copies of the Materials and is subject to the following restrictions: 1) you must retain, on all copies of the Materials downloaded, all copyright and other proprietary notices contained in the Materials; 2) you may not modify the Materials in any way or reproduce or publicly display, perform, or distribute or otherwise use them for any public or commercial purpose; and 3) you must not transfer the Materials to any other person unless you give them notice of, and they agree to accept, the obligations arising under these terms and conditions of use. You agree to abide by all additional restrictions displayed on the Site as it may be updated from time to time. This Site, including all Materials, is copyrighted and protected by worldwide copyright laws and treaty provisions. You agree to comply with all copyright laws worldwide in your use of this Site and to prevent any unauthorized copying of the Materials.
Nothing contained herein will be construed as conferring by implication, estoppel or otherwise any patent, industrial design, trademark or other intellectual property right of BNR Supercars or any third party. BNR Supercars makes no representations or warranties that any use of the information contained on this site will not infringe any patent, industrial design, trademark or other intellectual property right of any third party(ies).

3. DISCLAIMER: By purchasing this product from BNR Supercars, LLC either directly or through the BNRturbos.com website, you are agreeing to all sections of the Terms and Conditions. THE MATERIALS MAY CONTAIN INACCURACIES AND TYPOGRAPHICAL ERRORS. BNR SUPERCARS DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE MATERIALS OR THE RELIABILITY OF ANY ADVICE, OPINION, STATEMENT OR OTHER INFORMATION DISPLAYED OR DISTRIBUTED THROUGH THE SITE. YOU ACKNOWLEDGE THAT ANY RELIANCE ON ANY SUCH OPINION, ADVICE, STATEMENT, MEMORANDUM, OR INFORMATION SHALL BE AT YOUR SOLE RISK. BNR SUPERCARS, LLC RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CORRECT ANY ERRORS OR OMISSIONS IN ANY PORTION OF THE SITE. Information Provided by You: Any information you transmit to this site (excluding personal information which is addressed in the Privacy Policy), including questions comments or suggestions will be considered non-confidential and non-proprietary. BNR Supercars, LLC does not want you to, and you should not, send any confidential or proprietary information to BNR Supercars or the site BNRturbos.com. You agree that any information or materials that you or individuals acting on your behalf provide to BNR Supercars will not be considered confidential or proprietary. By providing any such information or materials to BNR Supercars, you grant to BNR Supercars, an unrestricted, irrevocable, worldwide, royalty-free license to use, reproduce, display, publicly perform, transmit and distribute such information and materials, and you further agree that BNR Supercars, is free to use any ideas, concepts or know-how that you or individuals acting on your behalf provide to BNR Supercars. You further recognize that BNR Supercars does not want you to, and you warrant that you shall not, provide any information or materials to BNR Supercars that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another.

5. INSTALLATION OF PRODUCT: We are not responsible for OEM or aftermarket parts of the vehicle that are damaged for any reason. If in doubt, please have all aftermarket parts fitted by a professional installer and call or email BNR Supercars, LLC to discuss installation problems.

6. CONDITION OF VEHICLE: BNR Supercars, LLC assumes that all vehicles used during installation through our product or service are in good working condition, and have been reviewed by the customer or professional to ensure that the vehicle will be able to handle any additional power or performance. It is the customer’s sole responsibility to ensure this information is accurate. BNR Supercars, LLC will not be held liable for any unforeseen damage that may happen to the vehicle.

7. SAFETY: BNR Supercars, LLC is not responsible for improper, unsafe, reckless, or careless driving of vehicles after installing any of our products or using our services. We does not encourage violating any State or Federal laws including emission laws. Items sold assumes our product or service will be used within a safe and legal manner or that the customer has done their due diligence to ensure safe and legal use for off-road and/or race use only and takes full responsibility for the safe use of products.

8. PRODUCT USE: All items sold through BNR Supercars, LLC and BNRturbos.com are intended to be used legally and according to your applicable emissions standards. If you intend to use the products outside of their intended legal on-road use, then you agree to only use the products in an off-road/race use capacity limited to racing formally sanctioned by a recognized racing organization. Any other use, including recreational off-road use, may be in violation of local, state, and Federal laws. You agree that BNR Supercars, LLC has no control over how you use the products and it is entirely the responsibility of the consumer to determine what is legal use in their area and to use products in a legal capacity.

9. PHOTOS OF PRODUCTS: Product images shown are for illustration/representation purposes only and may not be an exact representation of the product. BNR Supercars reserves the right to change product images and specifications at any time without notice. If you are unsure about the product in the picture compared to the item listing please contact us before purchasing.

10. TAXES/DUTIES: Taxes will be charged at your local tax rate in states applicable. We are not responsible for any potential duty or custom fees for any parts shipped out of the US. These duties/fees are the purchaser's responsibility.

 

11. FREE SHIPPING: Orders may qualify for free shipping based on your order meeting set criteria. These criteria may include, but are not limited to, order total, order weight, domestic vs. international, delivery location, box count, etc. Unless we have told you otherwise, free shipping is only applicable for addresses within continental United States (lower 48 state).

Some products may also display as eligible for free shipping based on your location and what delivery services are available to your location.

Products can also be excluded from free shipping and will say as such when that is the case. These are usually due to product weight and or size. Any displayed Free Shipping promotions for a product are limited to the continental United States (lower 48 state) or digital delivery.

12. OVERNIGHT SHIPPING AND SHIPPING CHANGES: Overnight, Next-Day Air, or Express shipping means only that your order will ship using the selected service. It is not guaranteed that your order will ship the day it is placed. Orders placed before 3:00 PM EST typically ship the same day IF it is in stock and does not need customization.

Weekend and holiday services are not guaranteed. Saturday delivery service options will not show at check out the Friday before. Contact BNRturbos for expedited shipping service options prior to placing your order.

BNRturobs works diligently to ship each order as fast as possible. For your benefit, we often elects to upgrade your shipping service to an equal or faster method. FedEx, UPS, and USPS pick up packages Monday-Friday. Please note, orders placed for express shipping after cut-off time or on weekends will ship the next business day. This means overnight orders placed after cut-off time on Friday will ship on Monday. 

13. DAMAGED PRODUCT PROCEDURES: All items purchased from BNRturbos.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. We ship all items WITH shipping insurance and are not responsible for damages caused during shipping. DO NOT file a claim with the shipping company if your item was damaged during transit. If you file a claim through the shipping company, it will be denied. Please contact us WITHIN 24 HOURS so we can initiate the correct compensation procedures through the shipping company. You may be asked to send pictures of the parts and packaging for claim purposes. PLEASE INSPECT YOUR ITEM BEFORE SIGNING FOR IT, IF YOU DO NOT AND IT IS LATER DISCOVERED THAT THE ITEM IS DAMAGED, YOUR CLAIM WILL BE DENIED! Make the shipper wait if you must, make sure to ALWAYS inspect ANY package you get before the shipper leaves. Any damage not reported within 24 hours cannot be disputed and we will not be able to initiate a claim.

14. BNR Returns Policy: We do not do cancelations or refunds once a product reaches the fulfillment status (meaning its started the shipping process).  Custom products requiring a core can not be canceled once we start working on your core and if canceled prior you must provide a return shipping label to receive your core back.  In order to cancel any order the customer must call and speak to a BNR Supercars representative about cancelation and a refund.   I apologize for any inconvenience.  If you have any question about choosing the correct turbocharger for your application, please call to consult!

We stopped doing refunds due to improper return packaging, greasy hand prints, scratches on freshly machined surfaces, damaged goods was always the case! Turbochargers were mounted but the customer says “its still new in the box”.  All the gaskets and turbo were thrown back in the box with no packing to protect it!  I’m sorry, we can’t do refunds any more.

15. Warranty: BNR Supercars LLC has a limited (12 month warranty from invoice date) with every turbocharger we build. BNR Supercars guarantees its products will be free of defects in workmanship and materials upon delivery. The warranty only covers turbocharger repair, if defective, and does not cover damage due to abuse, misuse, or neglect. BNR Supercars does not cover products if not utilized in accordance with BNR Supercars intended purpose nor incorrect installation of said products. BNR Supercars is not responsible for any damage that a BNR Supercars product may cause to other parts or products. BNR Supercars LLC is not responsible for any labor or the postage of turbocharger(s) to or from the purchaser.

16. Important notice - effect on other warranties: Installation of BNR Supercars, LLC products (or similar products from other manufacturers) on a motor vehicle or engine may void, reduce or otherwise adversely affect any warranties given by the manufacturer or seller of the vehicle, engine or other component parts. BNR Supercars, LLC shall not be liable for any such adverse effect on such other manufacturers' or sellers' warranties.

17.  International Users and Choice of Law: This Site (BNRturbos.com) is controlled, operated and administered by BNR Supercars, LLC from its offices within the United States of America. BNR Supercars, LLC makes no representation that materials at this site are appropriate or available for use at other locations outside of the United States and access to them from territories where their contents are illegal is prohibited. You may not use the Site or export the Materials in violation of U. S. export laws and regulations. If you access this Site from a location outside of the United States, you are responsible for compliance with all local and other applicable laws. These Terms and Conditions of use shall be governed by the laws of the State of Alabama, without giving effect to its conflict of laws provisions.

These Terms of Use, the Privacy Policy, the Limited Warranty, and Shipping/Returns/Cancellation Policy and any and all other notices and policies contained on the site constitute the entire Agreement between BNR Supercars, LLC and you with respect to your use of the site and any purchase of products using the site. This Agreement supersedes anything in the site inconsistent with this Agreement. No waiver of any of this Agreement will be deemed a further or continuing waiver of such term or condition or any other term or condition. Any cause of action you may have with respect to your use of the Site must be commenced within one (1) year after the claim or cause of action arises within St Clair County, Alabama. If for any reason a court of competent jurisdiction finds any provision of the Agreement or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of the Agreement, and the remainder of this Agreement shall continue in full force and effect.
